Privacy Notice

How Spencer Models collects, uses, discloses, stores, and protects personal information, including application materials and separately authorized digital-likeness data. Last updated: July 28, 2026

1. Who we are and what this Notice covers

Spencer Models & Management, Inc. (“Spencer Models,” “we,” “us,” or “our”) operates spencermodels.com and provides talent representation, casting, content production, booking, and licensing services.

This Privacy Notice explains how Spencer Models collects, uses, discloses, stores, and protects personal information. It applies to website visitors, model applicants, influencer-casting applicants, photographers and filmmakers, brand and agency contacts, represented talent, creative partners, and anyone else who interacts with us.

Separate representation, casting, contractor, production, booking, and licensing agreements may contain additional privacy, consent, ownership, and data-use terms. This Privacy Notice does not itself authorize Spencer Models to create or use an AI-generated or AI-augmented version of anyone’s face, body, voice, identity, or likeness. That authorization only ever comes from a separate written agreement.

2. Information we collect

Information you provide directly. Depending on how you interact with us, this may include your name, email address, phone number, city, state, and age confirmation; your height, preferred market, experience, availability, and representation preferences; photographs, video, audio, comp-card information, measurements, portfolio links, and social profiles; your ideas for the influencer persona, including values, boundaries, and comfort with public association; photographer and filmmaker information such as creative disciplines, markets, portfolios, rates, and production capabilities; brand and agency information such as company details, campaign concepts, budgets, launch dates, intended uses, and uploaded briefs; and, for active relationships, communications, approvals, contracts, booking and licensing records, and payment information.

Please do not submit government identification, tax records, financial-account details, health information, or other highly sensitive records through a general website form. If we ever need documents like these, we will request them through an approved secure method.

Information collected automatically. When you visit the Site, we and our service providers may automatically collect limited technical information, including your IP address, browser and device type, operating system, pages viewed, referring URLs, dates and times of visits, cookie or similar identifiers, approximate location derived from an IP address, and security, error, and form-submission logs. This information may be associated with a browser or device and is not necessarily anonymous.

Information from other sources. We may receive information from brands, agencies, production partners, referrals, publicly available professional profiles, and social platforms, and we use it only for legitimate agency, casting, production, security, and business purposes.

We treat photographs, video, audio, physical measurements, and digital-likeness source materials as sensitive information internally, regardless of how any particular law classifies them.

3. Application materials and AI augmentation

Your application is not your consent. Photos, videos, audio, portfolio materials, social links, and other information submitted through an application are used to evaluate the application, confirm eligibility, communicate with you, prevent fraud, and administer the casting or review process.

Unless and until you sign a separate written agreement, Spencer Models does not use application materials to create a digital likeness, to generate commercial or public-facing content, to train, fine-tune, test, or improve an AI model, to create a faceprint, voiceprint, digital replica, or synthetic persona, or to license your face, body, voice, identity, or likeness to anyone.

If you are not accepted, or you ask us to, we delete your submitted materials on the schedule described in Section 8.

Separately authorized work. If you are selected and choose to participate in AI-augmented work, the applicable written agreement identifies the approved source materials; what digital-likeness assets or technical representations may be created; the purpose and permitted uses; the brands, categories, and campaigns involved; the approved channels, territory, term, and compensation; the production and technology providers involved; applicable restrictions and prohibited uses; security, retention, deletion, and post-termination treatment; and your approval, withdrawal, and dispute rights. Where biometric identifiers or similar derived data are created, they are collected only with written consent, used only within the signed authorization, and destroyed when the relationship ends, with written certification available on request.

4. How we use personal information

We use personal information to review applications; respond to inquiries; evaluate potential representation and project relationships; submit represented talent for appropriate opportunities; coordinate castings, bookings, productions, and appearances; create and maintain approved model profiles and comp cards; administer separately authorized AI-augmented projects; manage contracts, approvals, licensing, royalties, payments, and accounting; operate, secure, and improve the Site; prevent fraud and abuse; comply with law and enforce agreements; and complete a merger, acquisition, restructuring, financing, or sale of all or part of the business. We do not use application materials for purposes materially incompatible with the purposes described at collection without obtaining any additional consent the law requires.

5. Public model profiles

If you become represented talent, information authorized under your agreement may be published on the Spencer Models website, social channels, comp cards, casting materials, and client-facing systems. Public information may include a professional name, market, height, measurements, photographs, video, portfolio information, and booking or licensing availability.

Public information can be indexed by search engines, cached, downloaded, or copied by third parties. We remove information from channels we control as required by your agreement or applicable law, but we cannot guarantee deletion from independent websites, search caches, archives, or previously distributed materials.

6. When we disclose information

Service providers. Companies that support hosting, security, form processing, email, cloud storage, analytics, e-signatures, accounting, and payments, under confidentiality terms and only as needed to do their jobs.

Brands, agencies, and production partners. Prospective and current clients, agencies, photographers, filmmakers, producers, stylists, and locations, when necessary to evaluate, submit, cast, book, license, or produce work. This includes providing curated talent selections to a prospective client before a campaign is finalized.

AI and creative-production providers. Technology and production providers involved in separately authorized AI-augmented work. Application materials are never provided to these vendors for AI use without the required separate agreement.

Professional and legal recipients. Attorneys, accountants, insurers, auditors, regulators, courts, and law enforcement when reasonably necessary to comply with law, protect safety, prevent fraud, resolve disputes, or defend legal rights.

Business transactions. Potential buyers, investors, lenders, or successors in connection with a merger, sale, financing, or restructuring, subject to appropriate protections.

The public. Information that represented talent or another individual has authorized us to publish.

Spencer Models does not sell application materials, photographs, videos, voice recordings, or digital-likeness source materials. Spencer Models does not sell personal information and does not share it for cross-context behavioral advertising.

7. Cookies, analytics, and privacy signals

We use cookies and similar technologies for essential site operation (WordPress and our hosting provider, WP Engine), security and performance (Cloudflare), form functionality (Fluent Forms), and analytics (Google Analytics, via Google Site Kit). These technologies collect browser, device, usage, and cookie-identifier information. Our analytics configuration is used to understand site usage; we do not run advertising or remarketing tags on the Site.

You can control cookies through your browser settings; blocking some cookies may affect site functionality. Because there is no accepted technical standard for Do Not Track, the Site does not respond to Do Not Track signals. Where applicable law requires it, we honor recognized opt-out preference signals such as Global Privacy Control for legally defined sales, sharing, or targeted advertising.

8. How long we keep information

We keep personal information only as long as reasonably necessary for the purpose it was collected, the relationship involved, and applicable contractual, accounting, legal, and security requirements. Our standard retention periods are: model, influencer, photographer, and filmmaker applications that do not result in a relationship, up to 12 months; brand and general business inquiries that do not result in a project, up to 24 months; active representation, booking, licensing, production, payment, and approval records, for the duration of the relationship plus the period needed for contractual, accounting, dispute-resolution, and legal purposes; public profile information, while authorized by the applicable agreement; technical and security logs, 90 days; and backup copies, until the normal backup-expiration cycle completes, generally within 60 days of deletion from active systems.

We may keep a limited record of a request or transaction where necessary to document compliance, prevent fraud, enforce an agreement, or satisfy a legal obligation. Where biometric identifiers or similarly regulated derived data exist, retention and destruction are also governed by the applicable written authorization and relevant law.

9. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information, including encrypted transmission, access controls, restricted administrative permissions, and vendor review. No method of transmission or storage is completely secure, so we cannot guarantee absolute security, but we match our safeguards to the sensitivity of the information involved.

10. Your choices and privacy rights

Depending on where you live and your relationship with us, you may have the right to ask whether we process your personal information; access or obtain a copy of it; correct inaccurate information; request deletion; request restriction of certain processing; withdraw consent for future processing where processing is based on consent; opt out of marketing; opt out of any legally defined sale, targeted advertising, or qualifying profiling; appeal a decision about a privacy request; and exercise these rights without discrimination or retaliation.

Withdrawing consent does not retroactively invalidate processing that was previously authorized, and deletion may be limited by an active agreement, existing license, accounting requirement, legal obligation, or dispute.

To submit a request, email [email protected] with the subject line Privacy Request. We may take reasonable steps to verify your identity, and an authorized agent may submit a request on your behalf with proof of authority. We respond within thirty days of verifying the request wherever we can, and never later than the period applicable law allows. If we deny a request, we explain why; to appeal, reply with the subject line Privacy Appeal and tell us why the decision should be reconsidered.

11. International visitors

Spencer Models is based in the United States. Personal information may be processed in the United States and in other locations where our service providers operate, and privacy laws there may differ from the laws where you live. Where applicable law requires additional safeguards for an international transfer, we use an appropriate legal mechanism. Our applicant programs are directed primarily to adults in the United States.

12. Age requirements

You must be at least 18 years old to submit a model application, influencer-casting entry, or photographer or filmmaker application. The Site is not directed to children, and we do not knowingly collect personal information from anyone under 18 through those programs. If we learn that an underage person submitted information, we delete it from active systems unless the law requires retention.

13. Changes to this Notice

We may update this Notice as our services, technology, vendors, and legal obligations change. When we do, we revise the date at the top of this page, and if a change materially affects how we use previously collected information, we provide any additional notice or consent the law or your agreement requires. Changes to this Notice do not expand previously granted likeness, AI, content, or licensing rights.
