Terms of Use

1. Acceptance and scope

These Terms of Use govern your use of spencermodels.com (the “Site”), operated by Spencer Models & Management, Inc. (“Spencer Models,” “we,” “us”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

These Terms cover use of the Site only. Representation, casting, booking, licensing, production, and contractor relationships are governed by separate written agreements, and nothing in these Terms grants Spencer Models any rights to your likeness, voice, or creative work, or creates any obligation for Spencer Models to represent, cast, book, or hire anyone.

2. Using the Site

You may use the Site for lawful purposes connected to learning about Spencer Models, applying to our programs, browsing represented talent, and contacting us about legitimate business. You may not use the Site to violate any law, infringe anyone’s rights, misrepresent your identity or authority, interfere with the Site’s operation or security, or attempt to gain unauthorized access to any system, account, or data.

3. Applications and submitted materials

When you submit photos, video, audio, portfolio links, text, or other materials through the Site, you confirm that you are at least 18 years old, that the materials are yours to share, and that sharing them does not violate anyone else’s rights or any agreement you are bound by. Never submit material you lack the rights to share, and never submit another person’s confidential information.

Submitting an application gives Spencer Models permission to review and evaluate your materials for the purpose you submitted them and to contact you about your submission. It does not create a representation, casting, contractor, or employment relationship; does not guarantee any response, work, or opportunity; and does not grant Spencer Models any right to publish, license, commercially use, or AI-augment your materials or your likeness. Those rights exist only under a separate written agreement, as described in our Privacy Notice.

4. Our content and intellectual property

The Site and its contents, including text, design, graphics, logos, photographs, video, model profiles, comp cards, and the Spencer Models name and marks, are owned by Spencer Models or licensed to us, and are protected by copyright, trademark, and other laws.

You may view the Site for personal and legitimate business purposes. You may not copy, scrape, harvest, download in bulk, republish, or redistribute Site content; use any model’s image, likeness, or profile information for any commercial, promotional, or editorial purpose without a written license from Spencer Models; or use any Site content, including model images, to train, fine-tune, or develop any machine-learning or AI system. Automated access for search-engine indexing of public pages is permitted; all other automated collection is not.

5. Talent profiles are informational

Model profiles, statistics, availability labels, and rates shown on the Site are informational and subject to change. They are an invitation to inquire, not an offer. All bookings and licenses require written confirmation from Spencer Models, and every AI-augmented use additionally requires the model’s separate written authorization.

6. Third-party sites and services

The Site may link to websites and services we do not control, including social platforms and form and payment providers. Their terms and privacy practices are their own, and we are not responsible for them.

7. Disclaimers

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Spencer Models disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and does not warrant that the Site will be uninterrupted, error-free, or secure.

8. Limitation of liability

To the fullest extent permitted by law, Spencer Models and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

9. Indemnification

You agree to indemnify and hold Spencer Models harmless from claims, damages, and expenses, including reasonable attorneys’ fees, arising from materials you submit, your use of the Site, or your violation of these Terms or of anyone else’s rights.

10. Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to their jurisdiction.

11. Changes to these Terms

We may update these Terms as the Site and our services change. When we do, we revise the date at the top of this page. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms. Changes to these Terms do not expand any previously granted likeness, AI, content, or licensing rights.
